In recent years, the development of the energy sector has been characterised by developments at the EU level and in the area of renewable energy. The share of renewable energy in the supply of electricity and heat is growing constantly.
This rapid growth in the energy sector comes with a large number of legal questions. Our many years of experience in this area make us your competent contact in all matters of Austrian and European energy law, especially with regard to EU law, environmental law, state aid law, cartel law, property law, corporate law and labour law. One focal point is formed by renewable energy and associated questions of public and private law.

Advisory focus on energy law

In particular, we advise builders of power stations (national and international), suppliers of components and grid operators, as well as importers of gas from third-party states, especially for infrastructure projects, compliance and for M&A (due diligence).
In addition, we represent energy companies – not only in regulatory issues – in front of authorities at the federal and state level, as well as at the EU level. In this regard, we always involve our experts in environmental law, procurement law and state aid law. Our experience in the field of EU law also serves us well.
In addition, we regularly advise state bodies, including in third-party states, on lawmaking, especially in the area of renewable energy.

Rail infrastructure

LGP has represented the biggest state railway company in Austria for almost a decade.

Broadcasting/television

This covers the regulatory matters governed by the Austrian broadcasting laws (ORF-G, PrTV-G, PrR-G and KommAustriaG), as well as cases under private law, such as production contracts. Advisory services encompass the advising and representing of broadcasting companies in all legal matters, especially in licensing procedures, questions of advertising restrictions, the digitalisation of radio and the creation/verification of contracts.

Advisory focus for radio/television

We  are your competent contact when it comes, for example, to applications for and/or  the granting of licences under the Private Radio Act (PrR-G) and the Audiovisual Media Services Act (AMD-G). The latter concerns above all private television operators. In addition to making applications for such broadcasting licences, our specialists also draft many extension applications for the expansion of existing broadcasting regions. Additionally, we represent broadcasting companies before the Austrian communications authority in complaint proceedings due to violations of the broadcasting laws, e.g. in the event of advertising violations or violations of the officially prescribed programme.
Furthermore, we draft  opinions on planned offers at the request of KommAustria. These concern topics under radio law and under competition and state aid laws.
